The following terms and conditions of service (“Terms”) constitute an agreement between you and Moneypass Pty Ltd (“we,” “our,” or “us”), a company incorporated in Australia. This agreement applies to your use of your Moneyback Token account as a user (“you” or “your”). By creating and/or using your account, you agree that you have read, understood, and accept these Terms as well as the contents of the Privacy Policy, and you acknowledge and agree that you will be bound by such terms, documents and policies.

We may at any time change, add or remove any part of these Terms by posting amended Terms on our website. If any modification is unacceptable to you, you should stop using your account. Unless otherwise specifically set forth in the relevant amended Terms, all changes will be effective upon the date the amended Terms are published on our website. Your continued use of your account following the effective date will constitute binding acceptance of the Terms and agreement to be bound by the changes specified therein. It is your responsibility to frequently check and review the Terms so as to be aware of our most current Terms. If any new content, products or services become available, they will be considered as part of our services and your use of them will be governed by the Terms (as amended from time to time).

  1. Membership
    1. You may only apply to be a member of Moneyback Token if:
      1. you are aged 18 years or older; and
      2. you have a current Australian residential address. 
    2. By agreeing to these Terms, you represent that you are aged 18 years or older and you have a current Australian residential address. We will not be liable for any misrepresentation or fraud by you in any respect.
    3. To become a member, you must complete the registration form on our website.
    4. A maximum of one account can be owned and used by one user excluding any business account.
    5. We may decline your user application for any reason.
    6. As a vendor your information may be disclosed to other users’ portals or on our website.
    7. A breach or violation of any of the Terms by you will result in an immediate termination of your account.

 

  1. Your Commitments
    1. you must inform us if: -
      1. your personal details change including but not limited to, your name, address, email address or phone number.
      2. your personal details or your account details are compromised or any false claims are made through your account.
      3. you would like to delete your account.
      4. any error in relation to your account occurs including but not limited to balance disappearance after approval.

 

  1. Getting Moneyback
    1. Your points may be credited to your account after you get approval from the relevant vendor you had shopped from, and as the eligibility for conditional points reached, but if vendor declines your claim, then you may eligible to raise the matter to us and our team will handle the issue accordingly, which may take few weeks to resolve.
    2. If a customer returns one or all purchased items and receives a refund or receives a refund due to unsatisfaction of the vendor’s service or product, then it is the customer’s  duty to refund all claimed points on the relevant invoice to us even just a part of invoice has been refunding, customer can claim again with new invoice if a certain part of invoice was refund.
    3.  We may correct erroneous, invalid claims, adjustments for reversed transactions at any time which may result in your points balance going into negative, and will adjust into next claim points, if you want to close your account, then you need to pay the negative points to us. 
    4. Moneyback Token points do not expire unless you: -
      1. Have not claimed for 120 days and the points are sitting in portal, in this case the points balance will automatically expire.
      2. For a period of 12 consecutive months, you have not redeemed your points balance or not made any claim, in this case your account will be closed.
    5. You cannot transfer or sell your points balance to other users or businesses.

 

  1. Moneyback Token
    1. If you have points in your account you may use those points to upgrade your membership.
    2.  To redeem the your points you must read term and conditions Link.
    3. All Moneyback Token value availability is subject to the normal procedures, we are not responsible for any dispute between you and a vendor.
    4.  We are not responsible for any misleading information provided by a vendor.

 

  1. General
    1. We may make any kind of changes in these term and conditions.

 

    1. We will notify you of any changes to the terms and conditions by:
      1. Login Portal notification or
      2. Via email address you register with us.

 

    1.  We may terminate your membership immediately with or without notice if you: -
      1. Fail to comply with these terms and conditions or any other policy available on our website.
      2. Provide misleading information to us or to our vendor customers.
      3. Make a false claim.
      4. If you misbehave, or engage in abusive, or offensive behavior to any of our staff or our partner business staff or any person involved directly or indirectly with our business.
      5. Once your membership is terminated, any points to your name will be disappears from your portal and may not be reclaimed.
    2. We may provide your personal information to parties involved in a purchase or potential purchase of any part of our business.
  2. Refund Product or service Policy
    1. If you receives a refund from a vendor as a result of cancelling a transaction or service, it is your duty to cancel the claim and notify us through email or phone (keeping your reference number until the matter is concluded). If you fail to do so, we may take action against you. This action may include terminating you membership.
    2. When visiting our listed vendors it is your responsibility to choose any product or service, and we do not give any representations or warranties in relation to prices or quality of products or service of these vendors.
    3. To Redeem points you must meet the minimum number of points condition. To see the conditions please check “claim and redeem’ page or click here.
    4.  All your points will be displayed into your portal as customer and as vendor you will have all the balance claimed and approved in your portal.
    5. Although we will make every effort to send redeemed points value in the allotted period, this might not always be achievable. If you don't get your redeemed points value within the allotted delivery period, you need to contact us right away.

By using the website, you committed to abide by all relevant laws as well as these website conditions. If you use this website illegally, you might be held personally accountable.

    3. If user get any kind of information which user not expecting from us then need to inform immediately to us team via email or phone, this might be system error or website security breach result.

    1. All the published contents including graphics or non-graphics data on our website are the property of us and no one is authorized to copy any material unless we give written authority.
    2. You are not authorized to release or publish any kind of chat email or contents where we or any of our vendors or customers are directly or indirectly involved, unless we give written permission to do so.
    3.   You must not use our company, brand Trademark in any situation unless we authorized to do so.
    4. We reserve the right to make any changes on our website including review, edit, move contents or delete, and we are authorized to do so without notice.
    5.  As we may publish some advertisements for the service or products on the behalf of our vendors but we are not recommending any kind of warranty or guarantee in respect of those products. We will not be responsible for any kind of claims or other legal actions.
    6. We are authorized to monitor the website activities while used by users, non-users, authorities, and we have right to terminate or suspend the website or any of its part for any reason with or without notice and liability.
    7. To the fullest extent permitted by law, we and each of our directors, officers, employees, and agents disclaim all responsibility for any loss or damage (including, without limitation, direct, indirect, special or consequential loss, loss of profits, loss of data, or loss of opportunity) that you experience as a result of using our website or any content, whether arising in contract, tort (including negligence), equity, statute, or under any other cause of action.

  1. Login Portal
    1.  Customer dashboard will be accessible by our team and changes can be made accordingly, which will include but will not be limited to posting advertisement contents, posting offers recommended by the vendors, or other parties.
    2. The last four digits of the payment method, virtual phone payment id and your login id/user name will be disclosed to the vendor in order to validate the customer and match transaction data.
    3. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
    4. You must to read and agree with these Terms before submitting any claim.
    5.  You will be required to register on the site and establish an Account in order to enjoy specific features of the site and service. Only those who are 18 years old or older are eligible.

 

  1. Severability
    1.  In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms , such determination shall not affect the validity and enforceability of any other remaining provisions.

 

  1. Termination
    1.  The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
    2. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our website, products and services (or any part thereof).

    1.  The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
